These Terms of Use, together with our Privacy Policy https://www.digilexapp.com/privacy-policy, govern the access to and use of the Website (www.digilexapp.com) and digilex app® Service. All Services are provided by QSoft Labs GmbH, a limited liability company incorporated under the laws of Switzerland (“we”, “us”, “our” or “digilex app®”) to the customers and visitors.

“digilex app®” Terms of Use may be subject to regular updates and changes, so please ensure that you check them on a regular basis. These Terms of Use set out the general conditions for rendering Website and digilex app® Services. The Privacy Policy explains how we collect and use your information and data. By using digilex app Website and digilex app® Services, you represent that you are at least eighteen (18) years of age and that you are legally capable and authorized to accept to be bound by Terms of Use as an individual or as the representative of a legal entity. While QSoft Labs GmbH strives to deliver a reliable and accurate service, you understand, and agree that we cannot be responsible for the accuracy and timeliness of any and all information disseminated on the digilex app® Service and you nonetheless may be exposed to such information. You agree to use the digilex app® Service at your own risk.

2. Website and digilex app® Terms

You must be 18 years old or older to sign up to Website or create your account of digilex app®.

You must be a human. Accounts registered by “bots” or other automated methods or tools are not permitted.

You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.

Your login may only be used by one person. A single login shared by multiple people is not permitted.

You are responsible for maintaining the security of your account and password. digilex app® cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You may not use the Website or digilex app® Service for any illegal or unauthorized purpose. You must not, in the use of the Website or digilex app® Service, violate any laws in your jurisdiction.

3. Copyright

You understand that the digilex app® is a Legal Marketplace B2B mobile application, which contains software proprietary to QSoft Labs GmbH. QSoft Labs GmbH retains full title and ownership to the digilex app® Service, related content, trademarks, copyrights and all other intellectual property rights therein.

All copyright and other intellectual property rights in the form of texts, images or other content on this Website and digilex app® are the property of QSoft Labs GmbH or have been published with the consent of the respective owner.

Any copying, sharing or reproduction or other use of the information, brands, images, texts or logos or parts thereof for commercial purposes is strictly forbidden. Should you wish to reproduce any of the information on this Website or digilex app®, you must submit a request for approval to QSoft Labs GmbH at info@qsoftlabs.ch 

 

4. Your data

QSoft Labs GmbH is committed to the responsible use of personal data (see Privacy Policy statement). As a user subscribed to the newsletter of the Website https://digilexapp.com, or registered customer of the digilex app® you are wholly responsible for all information you send to us and verify that third-party rights are not violated.

 

5. Payments Terms & Conditions

A valid visa or master credit card is required for Digilex Premium accounts.

If you start a paying Digilex Premium subscription plan on a monthly basis, you will continue to be charged automatically each month on the same calendar day until you cancel. digilex app® Service is billed in advance on a monthly basis and is non-refundable.

If you purchase Digilex Premium subscription plan on a yearly basis, you will be charged immediately yearly fee until you cancel. The digilex app® Service is billed on a yearly basis and is non-refundable.

​There will be no refunds or credits for partial months of service, downgrade refunds, or refunds for months unused with yearly subscription. In order to treat everyone equally, no exceptions will be made.

All fees are exclusive of all taxes or VAT, and you shall be responsible for payment of all such taxes.

Any fees or charges applied on top of this transaction is carried out in terms of the arrangement between your card issuer and yourself. It is your responsibility to ascertain what if any fees there are as applied by your bank and/or card issuer.

If payment is made using a credit/debit card issued outside Switzerland, any currency conversion will be done according to the terms and conditions of the card and there may be additional fees charged by your card issuer.

​

​For any upgrade from Digilex Starter (Free plan) to Digilex Premium plan, your credit card that you provided will automatically and immediately be charged based on payment option selected (monthly or yearly basis).

​​

QSoft Labs GmbH will have no liability for transactions that are incorrect as a result of inaccurate information provided by you or for any loss of information caused by factors outside of the control of QSoft Labs GmbH or Google/Apple store.

​Cancellation your Digilex Premium plan will not cause the loss of features and access to premium service on a yearly or monthly basis subscription, until your subscription date ends.

6. Cancellation and Termination

You are solely responsible for properly canceling your Digilex Premium subscription plan. An email or phone request to cancel your subscription is not considered cancellation. You can cancel your subscription at any time by clicking on the Cancel Subscription button in your account. Your Digilex Premium subscription will immediately be canceled in real-time.

If you cancel the digilex app® Service before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again. You will continue to have full access to Premium service until your current paid month’s period is over.

QSoft Labs GmbH, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the digilex app® Service for any reason at any time. Such termination of the digilex app® Service will result in the deletion of your Account or your access to, and the forfeiture and relinquishment of all content and data in your Account. QSoft Labs GmbH reserves the right to refuse service to anyone for any reason at any time.

7. Modifications to the digilex app® Services and Prices

QSoft Labs GmbH reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the digilex app® Service (or any part thereof) with or without notice.

Prices of all digilex app® Services, including to monthly and yearly subscription plan fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Website (www.digilexapp.com).

QSoft Labs GmbH shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the  digilex app® Service.

8. General Conditions

Your use of the digilex app® Service is at your sole risk. The service is provided on an “as is” and “as available” basis.

Technical support is only provided to paying account holders and is only available via email.

You understand that QSoft Labs GmbH uses third party vendors and hosting partners to provide the necessary market data, news, hardware, software, networking, storage, and related technology required to run the digilex app® Service.

You must not modify, adapt or hack the digilex app® Service or modify another website so as to falsely imply that it is associated with the digilex app® Service, or QSoft Labs GmbH.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the digilex app® Service, use of the Website without the express written permission.

You understand that the technical processing and transmission of the digilex app® Service, including your Content, may be transferred unencrypted and involve
(a) transmissions over various networks; and
(b) changes to conform and adapt to technical requirements of connecting networks or devices.
QSoft Labs GmbH does not warrant that (I) the service will meet your specific requirements, (II) the service will be uninterrupted, timely, secure, or error-free, (III) the results that may be obtained from the use of the service will be accurate or reliable, (IV) the quality of any products, services, information, or other material purchased or obtained by you through the digilex app® Service or Website, will meet your expectations, and (V) any errors in the digilex app® Service or Website will be corrected.

You expressly understand and agree that QSoft Labs GmbH shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if QSoft Labs GmbH has been advised of the possibility of such damages), resulting from: (I) the use or the inability to use the service; (II) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (III) unauthorized access to or alteration of your transmissions or data; (IV) statements or conduct of any third party on the service; (V) or any other matter relating to the digilex app® Service or Website.

You understand that QSoft Labs has absolutely no obligation to refund or compensate any service fees paid by you, either in full or on a pro-rated basis, as a result of any service interruptions or any damage caused due to identity theft, incorrect/or inaccurate personal data, contact data or any misleading information provided of the registered Clients and Consultants.

The failure of QSoft Labs GmbH to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and QSoft Labs GmbH, and govern your use of the digilex app® Service and Website (www.digilexapp.com), superseding any prior agreements between you and QSoft Labs GmbH (including, but not limited to, any prior versions of the Terms of Use).
 

9. Links to other websites

In some circumstances, the use of links on the QSoft Labs GmbH websites takes you outside of the QSoft Labs GmbH network and systems. QSoft Labs GmbH assumes no responsibility for the content, accuracy or functionality of these third-party websites. Links are provided in good faith and the QSoft Labs GmbH assumes no responsibility for changes to third-party websites to which we provide links. The provision of links to other websites does not represent a recommendation on the part of the QSoft Labs GmbH. QSoft Labs GmbH therefore provides no guarantee or assurances, neither explicit nor implicit, that the content or data of this website or mobile app is complete, correct, reliable or up-to-date, or that it does not violate the rights of third-parties, or that this website and mobile app can be accessed without interruption or faults or viruses.

Neither QSoft Labs GmbH nor the Information Providers and their respective affiliates, agents or licensors, shall be liable to you , or any other person, regardless of the cause (unless resulting from the gross negligence or willful misconduct of QSoft Labs GmbH or the Information Providers) or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the digilex app® Service, Website or Information, or for any delay or interruption in the transmission thereof to you, or for any Claims or Losses arising therefrom or occasioned thereby. Neither QSoft Labs GmbH nor the Information Providers and their respective affiliates, agents or licensors shall be liable to you or to any other person for indirect, punitive, special, consequential or incidental damages (including, but not limited to, trading losses, loss of profits or anticipated profits, loss by reason of shutdown in operation or increased expenses of operation, cost of cover or other indirect loss or damage) of any nature arising from any cause whatsoever, even if QSoft Labs GmbH, the Information Providers, or their respective affiliates, agents or licensors have been advised of the possibility of such damages.

QSoft Labs GmbH reserves the right to update and change the Terms of Use from time to time without notice. Any new features that augment or enhance the current Service, including the new app release, shall be subject to the Terms of Use. Continued use of the Service after any such changes shall constitute your consent to such changes.

Any disputes or claims which may result from the use of the website https://digilexapp.com or are associated with it are subject to Swiss law.
